This Website is managed and operated by Medsnap under the laws of India, having its registered office at 10/455 Khalasi Lines Kanpur UP - 208002 (“we”, “Company”, “medsnap”, “us” or “our”).
Use of the Website is offered to You, subject to acceptance of all the terms, conditions and notices contained in these Terms including applicable policies which are incorporated herein by reference, along with any amendments/modifications made time to time by Company at its sole discretion and posted on the Website, including by way of imposing an additional charge for access to or use of a service(s).
This document is an electronic record in terms of Information Technology Act, 2000 (“IT Act”), the applicable rules thereunder and the provisions pertaining to electronic records in various statutes as amended by the IT Act. These Terms of Use constitute a legally binding agreement between you and MedSnap. By accessing or using the Platform, you represent and warrant that you have the legal capacity to enter into this agreement and agree to be bound by these Terms of Use.
2. Registration of your Account:
2.1 In order to access or use the Website you must set up an account by providing information about yourself as prompted on the sign-up page of the Website which may include your name, gender, mobile number and such other details relevant for placing orders through your account. Your login ID and password will be created basis the information provided by you, which you can use to access your Medsnap account at any time. Your credentials shared by you at the time of registration and your Medsnap login ID and password are referred to as “Account Information”.
2.2 You are solely authorized to operate the account created by you. Consequently, it is your responsibility to maintain the confidentiality of your Account Information. You shall remain solely responsible for all the actions by you on your account.
2.3 You will: (a) immediately inform us of any unauthorized use or security breach of your account, and (b) ensure that you log out of your account at the end of each session. You may be held responsible for any losses incurred to Reliance or any other user due to unauthorized use of their account, resulting from your failure to keep your Account Information safe, secure and confidential. We reserve the right to refuse access to the Website, terminate or suspend accounts, remove or edit content at any time without providing any notice to you.
2.4 We constantly monitor the user’s account in order to avoid fraudulent accounts and transactions. Users with more than one account or availing referral vouchers fraudulently shall be liable for legal actions under the applicable law and we reserve the right to recover the cost of Products, transaction fees, or any other related cost including attorney fees, from such person using the Website fraudulently. In an event we detect any fraudulent or failed transaction, prior to initiation of legal action, we reserve the right to suspend or delete such an account with immediate effect and dishonor all past and pending orders without any liability on our part. However, this shall not absolve the User from any liability.
3. Communication and Unsubscription:
3.1 You understand that once you have shared your Account Information and successfully registered on the Website, you may receive SMS or email notifications from Medsnap relating to your registration and transactions on the Website.
3.2 You consent to receive communications, notifications and commercial messages regarding any transaction / marketing / promotional activities that are related to your transaction on the website or the Products and Services that maybe available on the Website from time to time. By sharing your Account Information and registering on the Website and/ or verifying your contact number with us, you explicitly consent to receive marketing / promotional communications (through call, SMS, email or other digital and electronic means) from us and/or our authorized representatives regarding any new services or offerings.
3.3 While the Company endeavours to provide these notifications and reminders to you promptly, the Company does not provide any guarantee and will not be held liable or responsible for any failure to send such notifications/reminders to you.

4. User Warranties and Restrictions

5. Risks of using Medsnap’s Services
5.1 As with any medical procedure, there are potential risks associated with using the Services. By using the Services, You agree to abide by these Terms of Use, Privacy Policy and risks described below. These risks include, but may not be limited to:
5.1.1 By requesting a medical opinion through the Website, You acknowledge and agree that:
5.1.1.1 the advice/information/opinion on diagnosis You may receive could be limited and provisional;
5.1.1.2 the medical opinion is not intended to replace a face-to-face visit with a physician and it does replace an actual doctor-patient relationship;
5.1.1.3 in case of a second opinion where there is a difference of opinion among Our Medical Experts and Your physician, You would bear the responsibility to decide on online or offline consultation, or procedure, and/or treatment;
5.1.1.4 the Medical Expert is reliant on information provided by You and hence any information demonstrated to have been falsified, misleading or incomplete will immediately render the opinion and all details therein null and void;
5.1.1.5 in some cases, the Medical Expert may determine that the transmitted information is of inadequate quality and may ask for more information, without which he/she may refuse to answer the query;
5.1.1.6 in rare cases, the Medical Experts may feel that the query may not be answerable without physically examining the patient/ Users and the Consultation may be refused forthwith;
5.1.1.7 in very rare instances, security protocols could fail, causing a breach of privacy of personal medical information; and
5.1.1.8 delays in medical evaluation and answers could occur due to deficiencies or failures of the service as per those mentioned in these Terms of Use.
6. Access Outside the Republic Of India
6.1 The Company makes no representation that the content on the Website is appropriate to be used or accessed outside the Republic of India. Any user who use or access the Website from outside the Republic of India, do so at their own risk and are responsible for compliance with the laws of such jurisdiction.
